LIMITED WARRANTY
Rexcel guarantees that product sold will have
the required quality and will behave in every material aspect
according to Rexcel’s specifications and standards pointed
out in the technical sheets sent to distributors, The buyer will
assume all the risks derived from the use of the products bought,
whether they are used individually or in combination with other
materials or in any other process.
Claims Limitations
According to its own judgment, Rexcel will
replace, without ant additional charge every product that does
not comply with the warranty, or, previous return of the products
on Rexcel's account, it will reimburse the price paid by the
buyer.
Rexcel does not issue any warranty, implicit or explicit, based
on any kind of agreement or exchange practice, or in regards to
suitability for any particular use or any other situation which
is not mentioned herein or which is required by relevant laws. Rexcel's liability for any loss or claim or infringement of the
commercial value warranty will be solely limited to replacing the
faulty products or those which do not fulfill the requirements,
and to Rexcel's judgment will reimburse the price paid by the
buyer previous return of such products. Rexcel will in no case be
liable for any other particular, consequential, incidental or
exemplary damages.
Regardless of the course taken by the negotiations initiated by
the parties, the buyer is obliged to inspect the product at the
time of reception and before he begins any trimming or building.
Any claim made by the buyer for breach of warranty will be
considered void when the fault in question could have been
detected during such inspection unless the claim is sent by
writing to Rexcel within a period of 10 days after the date the
product on which the claim is based is received. In every case,
the claims which are not presented within a period of two months
after reception date will be void.
Rexcel will not be liable for defects or any other failure
derived from Faulty building or installation, incorrect use or
maintenance of the products when Rexcel instructions were not
followed.
The buyer will assume all risks derived from losses, damages or
injuries which occur to the buyer or to his property, not for any
other contingency resulting from the use or possession of the
products sold under these terms.
Rexcel guarantees that with normal use, service and application
its products will comply with the standards included in the
technical data sheets sent to distributors and intermediaries
during a 12 month period starting from the date to the first
buyer.
In case Rexcel's products do not work as guaranteed, the solution
for the first and only buyer will be limited to repairing or
replacing the complete product or the faulty part of it.
This warranty will only be applicable to the products in its
original installation and bought by the first consumer. The
warranty is not transferable and will mature at the moment of
resale or transference carried out by the first buyer.

any of the following:
1. Accidents, abuse or defective handling
2. Exposure to extreme temperature or humidity
3. Incorrect installation or application
4. Inadequate product maintenance
There is no other implicit or explicit warranty. Under no
circumstances at all will the manufacturer be liable for any loss
or damages derived from the purchase, use or inability to use the
product or for any special, indirect, incidental or consequential
cause.
